Terms and Conditions

These Terms and Conditions apply to the services provided by Konversate To Elevate in all Life Coaching and Mentoring, to Clients covering both Organisational and/or Individuals and is hereby contractual for the services that is to be provided by Konversate To Elevate Ltd.

The services being provided covers personal developments, transformation, goal setting and achievement, life coaching and mentoring for clients, which where required may include the monitoring of progress and reviews. You may be issued with assignments as part of the process in your progression towards the achievement of the end goal.

In line with the Life Coach and Client Agreement, that stipulates the Client maintains full responsibility for and accountability in setting the assignment tasks and completion of to maintain progress towards the end goal achievement.

Be aware and understand that Life Coaching is currently an unregulated industry within the United Kingdom and your Life Coach is therefore not licensed by any UK based bodies.

Disclaimer and Limitations of Liabilities

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without/short notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk.

The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Konversate To Elevate Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation loss of fee, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service

You the Client understand and accept sole responsibility for your own well-being, choices and decision making. Understanding that Konversate To Elevate Ltd is not a certified counselling, therapy, psychologist, medical and mental health care provider and therefore would not replace or act as these professional bodies in anyway. The Life Coach will however highlight if such services are required during any sessions, and it would be the clients responsibility to self-refer to the required professional body for proper support.

As a Client you understand the work of the Life Coach is specifically to the extent of working as a team/ together for your personal development, transformation and elevation with your full participation in line with the agreements outlined in the Terms and Conditions.

You accept that you the Client understand that the comments, options and ideas presented by the Life Coach are solely for the use in assisting in the achievement of the goal/s you outline with the Life Coach. Therefore, giving your sound and informed consent, with the full understanding that results are not guaranteed, and results are not foreseen.

INDEMNIFICATION
You agree to indemnify, defend and hold harmless Konversate To Elevate Ltd and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

As such, you therefore discharge, waive, release and acquit forever the Konversate To Elevate/Life Coach of any and every claim, demand, compensation request and suit of action from you and all whom in representation of you (the Client) regarding any demands for damages or right to compensation for damages and/or distress you may claim to have or that you may have occurred out of acts or omissions by yourself or by your Life Coach as a result of the advice provided by your Coach or otherwise resulting from the Life Coaching relationship stipulated by this agreement.

You also note, declare and represent that no enticement, no coercion, no promise and no agreement external to this Terms and Conditions, the Life Coach & Client Agreement and Service Policy has been made to you to sign this and any of the agreements. You are therefore bind by this Agreement and all as stated agreements, which also bind all third parties whom are representations and/or acting on your behalf inclusive of heirs, executors, next of kins, agents, successors, friends, personal representatives and all whom seek to act in your stead.

Service Provided

Konversate To Elevate Ltd agree to undertake and provide a service as set out in the Life Coach & Client Agreement, The Service Policy and these Terms and Conditions. Therefore, the Client agrees to pay all fees as agreed for the service and selected package. Should the fees be paid by a third party on behalf of the Client, the third party would be seen as acting on behalf of the Client as an agent. The upon the start of the first session, this would be deemed the beginning stage of the service.

Sessions

In line with the Life Coach & Client Agreement, scheduled package sessions are timed at 1hr ½ to be undertaken either via Face to Face, Skype, WhatsApp, Online Video, Telephone and/or Mobile which remains within the client’s choice of comfort. Client is also required to permit the recording of and/or non recording of sessions.

There would be a mutual agreement between the Life Coach and Client on what format is best. Please refer to the Life Coach & Client Agreement for full details which also needs to be signed by client should they agree.

Client understands that using technology is not always secure and accept the risks to confidentiality when using all technologies to communicate and/or deliver sessions.

All fees and packages are set out on the Pensight platform and fees to be paid by Client on said platform where the schedules would also be booked. Fees can be paid online as set out on the platform via the stripe gateway and all payments would be honoured even if prices rise between time of bookings.

SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Confidentiality

Konversate To Elevate Ltd will treat personal and supplied information provided by the Client in sessions with confidentiality. The supplied information will not be disclosed to any third parties without the written prior permission of the Client, except where action needs to be taken or required by law in the prevention of criminal activity and/or harm to others and the client.

The Life Coach will maintain and ensure to protect your (The Client) confidentiality unless you state otherwise, which needs to be in writing and permit/understand your Life Coach has the right and responsibility to any necessary actions where required should any criminal breaches and risk be it to yourself or others within you reach become present. This would then limit the confidentiality capacity and therefore also deem your Life Coach will provide information to the courts and/or attend to testify to the extent the law requires.

Terms and Conditions Changes

Konversate To Elevate Ltd reserves the right to make any changes, which would be communicated with the Client in writing should there be active sessions being undertaken and would only affect the active sessions once jointly agreed between Client and Life Coach.

Fee increase will not affect active sessions and therefore, would be communicated in writing to all active clients. Should Client be on an adhoc package, the fees will take effect as scheduled, and the Client can in writing cease the Life Coaching Agreement with immediate effect.
